Probate is the legal process for transferring an inheritance to the heirs of a deceased person. A decedent’s Last Will and Testament will be admitted by the Register of Wills, and a Personal Representative will be appointed to manage the Estate. The Personal Representative must marshal the decedent’s assets, i.e. assemble and control those assets, as well as compile an inventory and a final account. The various property items are allocated to heirs in accordance with the decedent’s Last Will and Testament, or in the absence of one, in accordance with the laws of intestacy. The Personal Representative can make final distributions to the heirs if all taxes and creditors have been paid and a final accounting has been approved by the Orphans’ Court.
